Vulnerabilityhastraditionallybeenviewedthroughthelensofspecificgroupsofpeople,suchasethnicminorities,children,theelderly,orpeoplewithdisabilities.Withtheriseofdigitalmedia,ourperceptionsofvulnerablegroupsandindividualshavebeenreshapedasnewvulnerabilitiesanddifferentvulnerablesub-groupsofusers,consumers,citizens,anddatasubjectsemerge.VulnerabilityandDataProtectionLawnotonlydepictstheseproblemsbutoffersthereaderadetailedinvestigationoftheconceptofdatasubjectsandareconceptualizationofthenotionofvulnerabilitywithintheGeneralDataProtectionRegulation.Theregulationoffersaforward-facingsetoftoolsthat-thoughlargelyunderexplored-areessentialinrebalancingpowerasymmetriesandmitigatinginducedvulnerabilitiesintheageofartificialintelligence.Consideringthenewrisksandpotentialitiesofthedigitalmarket,thenewawarenessaboutcognitiveweaknesses,andthenewphilosophicalsensitivityabouttheconditionofhumanvulnerability,theauthorlooksforamoregeneralandlayereddefinitionofthedatasubject’svulnerabilitythatgoesbeyondtraditionallabels.Indoingso,heseekstopromotea’vulnerability-aware’interpretationoftheGDPR.Aheuristicanalysisthatre-interpretsthewholeGDPR,thisworkisessentialforbothscholarsofdataprotectionlawandforpolicymakerslookingtostrengthenregulationsandprotectthedataofvulnerableindividuals.
